These terms govern use of Magic Beans ("the system"), a private automated trading tool connected to your own Etrade brokerage account. By using the system you agree to these terms.

The service

Magic Beans monitors market data and, according to rules and thresholds you configure, places and manages orders on your own connected brokerage account. It is a tool operated for its account holder(s); it is not investment advice, and no message, notification, or feature of the system should be interpreted as a recommendation to buy or sell any security. You are solely responsible for the trading configuration you choose and for all activity in your brokerage account.

Account responsibilities

You are responsible for keeping your login credentials confidential, for the accuracy of the contact information (email address, mobile phone number) you provide, and for the brokerage credentials you connect to the system.

SMS / text messaging program terms

This section applies if you provide a mobile phone number and enable SMS notifications on the Settings page.

• Opt-in. Providing your mobile number and enabling an SMS notification toggle is your affirmative consent to receive text messages from Magic Beans about your own trading account. Consent to receive SMS messages is not required to use the rest of the system - you can use Magic Beans with SMS notifications turned off.
• Message types. Messages may include trade confirmations (buys and sells), a pre-market "not yet connected" reminder, and market open/close notices.
• Message frequency. Frequency varies with your own trading activity and which message types you have enabled; there is no fixed number of messages per day, week, or month.
• Message and data rates may apply. Carrier message and data rates may apply to messages sent to you. Contact your mobile carrier for details about your plan.
• Opt-out. Reply STOP to any message at any time to unsubscribe; you will receive no further SMS messages after doing so. You can also disable SMS notifications at any time on the Settings page.
• Help. Reply HELP to any message for assistance, or contact us at the email address below.
• Carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
• No sharing. Your mobile number and SMS opt-in status are not shared or sold to any third party. See our Privacy Policy for details.

No warranty; limitation of liability

The system is provided "as is," without warranty of any kind. Market data, broker connectivity, and third-party notification providers can fail, be delayed, or be interrupted, and automated trading carries inherent financial risk, including the risk of loss. To the fullest extent permitted by law, the operator of this system is not liable for any trading losses, missed or delayed notifications, or other damages arising from use of the system.

Changes to these terms

We may update these terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the system after a change constitutes acceptance of the updated terms.
